Good points. Just to emphasize one: If there will be no "gene" patents, it is hard to see how "genomic" companies can make any money. If they are day or month or even year ahead of the public databases no one is going to pay them much. (Unless it is fashionable.) For patents it is important to be first. For genomic database it is not so crucial.
