because of QCOM's patent position they can essentially charge for any kind of data, or sound, sent over the airwaves until their patents are completely invalidated.

QCOM doesn't charge data and sound. QCOM charges royalties on devices that use QCOM patent-based semiconductors. Why should QCOM be allowed to charge based on the device ($1,000 iPhone) rather than based on the semiconductor ($20 baseband chip)? That's the question.
