It's probably that many of the out-of-state enrollment slots are occupied by foreign students.

Foreign undergrad students are usually paying the full tuition and for state unis that is the out of state rate. Foreign grads are mostly not paying tuition unless in professional programs like MBA (not sure there are that many of those?) or some healthcare programs. Don't know what the proportion paying tuition through funding sources like foreign governments and international agencies is. Very few can afford to pay from their own pocket for grad school. At most unis PhD fees are only a large amount while doing initial coursework anyway.
