As it turned out, but the original concept was pretty good. The trimester scheme allowed restrictions in both the second and third trimesters. That seems reasonable to me.

I appreciate your point about abuse of the mental health provision. I don't know a good way around it, though.

As a practical matter, the converse would likely have the same problem. If you criminalized abortion, you probably wouldn't get a lot of convictions. It would be hard to find twelve people who would convict unless the woman did something really outrageous like aborting a viable fetus because it was the wrong sex.
