Agreed. The infringer would have to expend millions upon millions in an attempt to make CDMA ASICs which, as you know, are very, very difficult to produce. Nokia I think finally did it, but it was only after many, many years of frustration and effort.

The infringer would then have to get into the handset business, one of the most globally competitive, and compete with Nokia, Samsung, et al.

All this effort and risk, including litigation, just to save on a measly 5% royalty? Seems a bit much to me.
