David: good point but I would think that Barrick would also have a additional window of due dili once MOU is signed (just like Freeport).

TP: From the Dow Jones story (and I think they have been most objective so far) Barrick still wanted to make a bid after their due dili. I am not sure if they still do after Freeport's results.
