A solution for a law?
First of all, the law doesn't seem to be stopping carpooling at present. Lots of people (though not enough) do it already and I'm sure there's money changing hands too. "Chipping in for gas" is a common phrase.
Since laws are made and unmade through the government, I don't see that a crisis would allow an insurance law to get in the way of the more incentivized approach either since the article mentions "coercion" and "force" brought to bear by the government.

I don't particularly like the idea of government-led forced or coerced behavior modification. That doesn't mean it can't happen though.

The EIA officially is stating that oil demand will outstrip supply in the fourth quarter of this year, as well as in Q1 and Q4 of 2006. Fun times ahead.
