Misonix Announces Jury Assessment of Damages in Favor of Mentor Corporation in Patent Suit

FARMINGDALE, N.Y.--(BUSINESS WIRE)--Feb. 24, 1999--Misonix, Inc. ("Misonix") (Nasdaq: MSON) today announced that the jury hearing the Mentor Corporation ("Mentor") patent lawsuit had issued a verdict in the amount of approximately $4,904,000 damages in favor of Mentor and against Misonix and the licensees of its device, Medical Device Alliance, Inc. and LySonix, Inc. Motions are pending before the Court, for expected decision this Friday, February 26, 1999, which could affect the results significantly with a potential range of final result running between eliminating the jury verdict against Misonix and the other defendants entirely or, on the other hand, entering a verdict in favor of the plaintiff, Mentor, entitling it to treble damages, plus attorneys' fees.

Misonix had earlier announced, on February 5, 1999, that the jury had returned a verdict in favor of Mentor and was then entering the damages phase of the trial. As previously stated, based upon the final outcome of this proceeding and the motions to be determined, Misonix leaves open the possibility of seeking relief through appropriate channels available through the courts.
