Alan Dershowitz just pointed out that the five members of the majority on the USSC normally don't see any equal protections violations when convicted criminals are executed following widely differing standards in due process, even after you show that minorities do not receive equal treatment.

His point was that the Supreme Court did not make an ideological decision; it was based on the names of the plantiff and defendant.
