Did you see where they want to make injuring a fetus during an assault a federal crime? Would that be unconstitutional or would that give the feds the power they're lacking? Generally laws against assault or murder are the responsibility of the state government not the federal government. Although I suppose if one state decided not to protect a certain group of people a federal case could be made under the equal protection clause. I like the idea of equal treatment under the law a lot, in fact I would say it is a vital legal principle, however it also is rather elastic and can allow for all sorts of things. For example in the recent SC decision about the FL vote. I think the SC would have been justified in stopping the recounts because according to the standards set by the FL legislature the count was done, the deadlines had passed, and according to the US constitution the legislature has the final say within a state on such matters, however they SC did not decide the case this way. Instead they they make it an equal protection case which opens up a big potential can of worms for the next close election. Tim
