The highest stakes are democratic self-governance versus judicial fiats that threaten to make a mockery of the American system of government by elected officials.

Sowell is right that judicial interference with legislative prerogative is noxious, but the legislature can always reassert itself.

The biggest threat to US freedom is gerrymandering because it leads directly to polarization (resentment by losers and triumphalism by winners) and thus to intolerance, overseen by permanent incumbents.

If Jones in Lowerarmpit knows that no matter what, Smith who he disagrees with, will always get elected and Smith knows it also, then do we really expect Smith to give Jones his serious attention?

If the opportunity comes, and Jones moves to Upperarmpit where Williams - whom he does agree with and who will give him serious attention - always gets elected, then should we be surprised when Jones makes the move?

And when the rules of large numbers have worked their magic and various Joneses have made their moves, should we expect the Smiths who control legislatures seriously talk with the Williamses who never get majorities?

And what sort of discourse is it when Joneses only ever talk to Joneses?

Should we be surprised when public speech decreases in intelligence and civility?

Where's the juice in going to vote if know you can never vote the old rascal out and the new one in?

Hell, where's the juice even in voting for the old rascal, when his victory is fore ordained?

Welcome to the age of the permanent incumbent, crappy thought, and bad language - an age when the winners sound nearly as angry and aggrieved as the losers.
