If by "basic rights", you mean the right to stay in the US, then it is a "no"; if you mean the right to be treated as human beings before being sent back, then it is a "yes".

JPR's response: Thanks for your response By basic rights, I mean schooling, a work permit until the case is resolved, and all the other rights except voting ?
The term "Illegal immigrants" applies mostly to & is an euphemism for South American and immigrants from third world countries. Illegal immigrants from Ireland, Eastern Europe are by law illegal immigrants but in practice immigrants who somehow slip the net or just plain not noticed. If you go to the pubs you may see our friendly illegal Irish work there. I welcome them, but they are very rarely noticed or caught.
