Vancouver stock promoter John Henry and his clipclip.com Enterprises, currently trading at 19 U.S. cents on the OTC Bulletin Board, have filed suit against five unflattering chat-site posters and two chat sites for a series of "false and malicious" comments. In an 11-page statement of claim filed Friday in the Supreme Court of British Columbia, Mr. Henry and clipclop.com seek assorted damages and injunctions against Stockhouse Media, Raging Bull and the five posters.
Vancouver lawyer Darrell Roberts of Roberts & Baker also seeks court orders to force Stockhouse and Raging Bull to immediately remove the offending messages and to disclose the true identities of WaveyDavey, Wavey, garpike, Montero and Cook81. In addition, Mr. Roberts also wants the two Web sites to hand over a list of any additional pseudonyms used by the clipcop five.
Mr. Henry notes that clipclop.com, previously known as Promark Software is on the verge of launching an equestrian information Web site, the objective of which is to provide extensive products, information, education and entertainment to North American horse owners and the service providers and employees involved in the North American equestrian industry. The suit reveals that clipclop.com is presently in the process of seeking some sort of financing.
"Statements transmitted and published over StockHouse.com and ragingbull.com about particular companies are accessible by literally millions of individuals including potential investors," states Mr. Roberts in the suit.
Mr. Henry takes issue with one Wavey post, number 57, on Raging Bull on Aug. 9, and a series of other posts by the other defendants from Nov. 15 to Nov. 22 on both Web sites. "By reason of these false and malicious publications, the Plaintiffs have been seriously injured in their character, credit and reputation," states Mr. Roberts in the court filing. Besides the injunctions and court orders, the suit seeks general, special, aggravated and punitive damages. No statements of defence have yet been filed.
