You keep missing the point that there is social and economic policy behind the way equity markets run. You need to take that as a given. We want to encourage growth of small capital enterprises and not just feed the gambling desires. As you pointed out, there are plenty of other casinos available, including futures and derivatives, as well as the options markets.

As to hedge funds - much of what they do is kept very close to the vest as they are largely unregulated. They are fighting attempts to change this.

They are experts at using warrants, options, arbitrage variants, off shore accounts, etc.

There is nothing called a "hedge fund exception." I think the intent there is that hedge funds know how to exploit loopholes. If you look at the recent Reg. SHO, there are loopholes and hedge funds are able to use them.
