Yours is a bogus argument intended to deflect from the problem.

Failures to deliver are not excusable. They may not be illegal, depending on how you view Reg. Sho.

The issue to be made is that there is no excuse for the number of Failures to Deliver.

Let's get rid of this scamming and forget about the semantics.
