Yes, you might. Since I've never owned this stock, that's exactly what I'm doing(not that I'll ever buy for sure).

I HAVE read the opposing view in great detail. I believe my disagreement with it is coming from an un-biased perspective, so far as I know(though I might get into an advocats role, even strongly, on occasion- I come by it honestly).

Yes, this forum is hardly the sole cause of TERN's fall from the 170's...first you have RB and all the others...then you have the fact that when you click on a NEWS link for TERN from anywhere on the NET you are directed to an in depth lawsuit...however convoluted a piece of reading I feel it is. I have a few places I can offer my opinion...I think it reasonable that I put it here- without the illusion that I could move the price of the stock as the SUDDEN WIDESPREAD DISSEMINATION of these, I believe, largely false charges HAS, IMO.

I don't think you can find I've looked offer up posts where someone was wrong on another issue- I have looked to offer some relating to character...and some where the author was wrong on points pertaining to relevant issues.

I've come to one realization of a problem. Cablelabs has been a part of this problem. Not because they wrote a cease and desist letter, but because their position in it, where-in they state in fact, that TERN was told S-CDMA will NOT be in Docsis at the "present time," is at least marginally inconsistent with their other statement indicating it is only "highly unlikely" the next release would include S-CDMA. Either way, of couse, this points to their expectation of TDMA being next, though they have made no decision in that regard!

TERN is one of "four vendor authors" invited to "work together" to make changes in the Physical Layer- and that quote with the word "author" is direct from the Cease and Desist Letter, while other correspondence makes it clear TERN is among the four.

So much for Pat Mudges claims flat claims that TERN was ruled out of DOCSIS authorship- let alone that a "final" decision was made ruling S-CDMA out of DOCSIS...only for the short run...and even short run inclusion is only "highly unlikely"...or is it a "NOT"? Let's ask a single Cablelabs member verbally over the phone why don't we? Ahem. This all goes to the relevance of the cease and desist order..and the question whether TERN should have imagined they were in possession of significant adverse information.

If they believed, or rather KNEW they'd not intended to deceive...and that notion was retracted later by Cablelabs, for one, then they certainly can't be expected to consider it(the letter) as adverse- and go around telling Ray Fritz he'd better not sell his stock when the price was clearly fair if not more than fair, in ANY reasonable persons mind, IMO.

So far as I know, despite all, Cablelabs remains open to S-CDMA's submittal whenever it may arrive in their lap. Hence, the "highly unlikely" near-term inclusion statement, rather than "absolutely impossible," IMO.

In any event, TERN's new "Multigate" Broadband Voice products for Hybrid Fiber Coax- as opposed to noisy old cable plant, may have just altered greatly S-CDMA's potentials perceived, if not real(was there all along).
