That blogger doesn't have his facts straight.

Both the lawyers and the plaintiff are taxed on the same money(i.e., the attorney fees).

It also applies, for the most part, only to employment litigation.

Personal injury recoveries are tax free, even when they include a component of lost wages.

This change in tax treatment for employment suits was an add on to a bill signed by Clinton.

Bush recently signed a bill changing the law, though I haven't had a chance to read it.
