7   Mr. Elgindy, you understand you have an absolute right to            
8   testify, and that the decision to testify is entirely your            
9   own.  Do you wish to testify in this matter?

10            DEFENDANT ELGINDY:  I think in light of --          
11            MR. LEVINE:  Can you give Mr. Elgindy any caution,           
12   if he's going to say anything other than whether he's going           
13   to testify?           
14            THE COURT:  Anything you say, Mr. Elgindy,           
15   beyond "Yes" or "No" can be used against you.  Go ahead, sir.           
16            DEFENDANT ELGINDY:  I guess in light of what I saw           
17   yesterday and today, and as a result or because of the ID           
18   situation being brought into this case, I do not believe that           
19   I can testify.  But I would like to, but I cannot.  So --          
20            THE COURT:  Your decision is not to testify?           
21            DEFENDANT ELGINDY:  That's correct, your Honor.
