Because July 31 was its fiscal year-end, these guys have until the end of October to file the 10-K. They have used the full allotment of time each of the prior two years. The earnings release has come a few days before that.

This is not necessarily a BK, but the company is in a very unstable operating position and the existence of three different creditors and absolutely no traditional means of raising new cash makes for no good options here. Something bad will happen for shareholders, either of an erosive nature and/or a mercilessly quick and heavily dilutive nature.
