Joe,

The patent announced by Microsoft that was issued on 1/13/98 is a follow-up
patent to a previously filed Microsoft patent which appears to be based on a
patent by the reference name of Fukinuki dating back to 1987.

While the description of this patent sounds like us "system for inserting and
recovering a data signal for transmission with a video signal" it however does
not relate to the VBI which WaveTop uses. This patent is for in-bank, the
active video portion of the signal. To the best of our knowledge, there has
been no proven execution of this system. In addition, this is not related to
the previously issued patents to WavePhore for it's in-bank system known as
TVT1/4.
