The administration did not make its case for its handling of prisoners when the issue first came up. It seemed to me that, rather than trying and failing, they didn't really try because, out of impatience or arrogance or whatever, they didn't think that such a paradigm shift needed to be vetted and justified. Or maybe they just thought they couldn't prevail in their persuasion. I could see where they were coming from and thought they might have had a good case for all of it (except the lack of judicial review) but I would have liked to see it all laid out so that I could make an informed judgment. That was a lost opportunity. There's been too much water under the bridge since then and this is one of the periodic boil overs.
