In the case of the recent suits announced against ADPT, the issue is not forward looking statements made under the Safe Harbor law passed two years ago. As I understand it, the plaintiffs are arguing that ADPT failed to properly communicate a change in accounting policy regarding unsold merchandise in the dealer channel. The company will argue that there was no change in policy.
