I think that in the case of a small matter
you are probably correct, But if a major
wrong has been done, Or if a pattern of abuse
can be shown. The arbitration limitation clause
would likely not get in the way of a civil
suit. The arbitration clause is obviously
just a means of limiting the number of
claims brought against them in court.
