Death spiral convertibles are not, strictly speaking, naked shorting. They're covered by a company's obligation to issue shares. I haven't the time to analyze each case individually, but I don't believe any of the companies in the NCANS group are victims of death spiral convertibles. If any are, they have themselves as much to blame as their financers. In this day and age the death spiral is not an obscure pitfall so there's little room for ignorance as an excuse.
