You got to the heart of the matter right there. I was shocked to read Bill Fleck's comments yesterday because they were so strong. I would not be surprised if the legal department for MS is at least going to write the standard "cease and desist" letter to Bill the Bear. The first amendment gives plenty of protection for free speech, but you cannot slander someone and hope to just say "never mind". Don't want to play lawyer here, but slander is generally defined in the common law as publishing an untrue statement, knowing it is untrue, (or being reckless about the truth of it) and intending by such publication to harm another's reputation.
