The community can be technically wrong and still win. The point I have tried to make is that if they win, it's a Pyrrhic victory. If the so-called open access becomes a precedent, it has the effect of increasing ATHM's subscriber base greater than otherwise, because it entrenches the MSO@Home network and brand. Why?

If T were to accept the open access model, there is the physical delivery problem. It is so easy to think that if a copper ISP just throws some money at a headend, voila, instant cable network, or throw money at a sponsoring big telco and voila, cable Internet to the home. It is only MSO@Home that knows how to do this and they don't know how to fold in n competitors. Maybe T should resist because it is so vague and no one has even tried a pilot test. Who has even designed such an open access arrangement? What equipment is needed to make it work?

In the end the only reasonable way to continue is to pay MSO on the ATHM network to superhost the access. That way they don't have to get into all the headaches ATHM has been through. They avoid the pain and cost to the extent they would try to provision and feed the headend. The copper ISPs need a few channels, they don't need the overhead of a complex network.

I wonder how much more ATHM makes if they only charge copper ISPs maintenance cost rent? I'll bet they make more that way than through Jermo's media theory assuming the system remains closed. Jermo thinks the access charge will go to zero. It wouldn't if ATHM was superhost. Is this obvious, or what?
