ah, So the business case for an ISP will be, "Do we pay the cost of upgrading the headend and connecting it the bone and still pay "rent for use of the local loop or pay ATHM to make the provisions and pay "rent" for the use of the local loop?" But either way the local loop can absorb up to or at least 10 ISP's? Then it becomes down to competion of content and costs?

My apologies, and they call you cryptic.<gg> The word I intended to use was "competition". The point I was hoping to clarify is this.
From what I have read and can understand, if an ISP wants access to the local cable loop and the courts allow it, it is "technologically" possible for that to happen. The ISP would be responsible for all the additional upgrades from the bone to the living room that their presence necessatates. (I read Ted's post and he raises some interesting problems with this arraingement.) This having been done, now the ISP must compete against the MSO within that local loop on the basis of 1.Cost of service 2. Content that the services would provide and to Ted's point 3. Quality of service.
