JFD, It looks to me that all 3 government witnesses did not do so well in the rebuttal phase. If MSFT is finished with Felton, I would give this round to MSFT---they won by a mile.
The next round with MSFT's witnesses should go pretty well. They have learnt that you should not be putting up too many of your own executives on the witness stand--that is why they won't have one this time. Those people had left huge trails dealing with corporate stategic planning (tough talk) that is being misused by the government. Instead, picking a hostile AOL witness was a good idea. I bet they picked the best one from AOL based upon the depositions. Maybe that guy won't try to do what Norris of IBM tried (unsuccessfully, i might add). Could we see an honest witness getting on the stand soon?
I hope AOL also realizes that making up facts for your own competitive advantage won't help in the long run as the future could hold many potential deals with Microsoft itself. I doubt MSFT will ever be friendly to IBM--bitter enemies to the end. That is why i think the AOL guy will be honest on the stand. That could be the biggest turn in the trial.
