Reading the article it appears that the court was asked to rule strictly on whether the plantif had a case that could be validly brought to the court in Virginia, i.e., whether the court of Virginia had jurisdiction, not whether the alleged libel was in fact libel.

Separate question...are you saying that if the defendant had stated: "IMO, you're a pedophile", as opposed to, "You're a pedophile" then the defendant would have been protected under his/her first amendment rights regardless of any damages that may have resulted?
