The fcc knows one of the major reasons cable is out in front of other residential broadband options is because the cable companies know they will profit! I think one of the reasons dsl has been anemic in comparison is that although the rbocs are best positioned to exploit it the legal framework (and existing data service cash cows) doesn't give them the same incentive... We'll see if the fcc changes their mind in 2-5 years when the cable infrastructure is substantially upgraded.
