Well, we at least know where Kennard stands on the issue. None of this surprises me. This whole open access issue can not be evaluated over a relatively short period of time. There are vast changes & investments taking place that will maintain a competitive landscape in the years going forward. The campaign by AOL et al. is IMHO an opportunistic move to seize a temporary distortion in broadband access in favor of the cables that will not last.

Kennard's comments indicate that he sees forest, & that the court decision must be lifted from among the trees to share "broader" view of broadband ACCESS to the Internet.
