Aside from the fact that what has been posted regarding the lawsuit are undisputable facts according to documents submitted by fcm ( fnet ), which you fail to even acknowledge, there is always the "small" item called discovery. If you are confused as to the meaning of the word "Discovery", I can tell you that it is not the "discovery card". Check out Iron Mike on raging bull.
