Not necessarily. An offer to sell something or do something may be legal in some states or areas and not in others. If they leave the offer open in the states in which it is illegal, they may be subject to trouble by making an illegal offer. A simple ad doesn't have this problem, since an ad isn't an offer to contract, but an invitation to you to offer to contract. But an offer to contract is a different matter.
