I'd like to take your analogy one step further.

The MSO owns the "cable store" where content is sold.

ATHM leases space in the store for the shelves. For lack of a better term call him an independant distributer.

On the shelves content is sold. AOL, SI, Yahoo! etc.

The public owns the land that the store is built on.

The store owner thinks distributer is doing a good job for his store. The distributer has a repuation for quality and makes the store look good both in the way he sets up the shelves and advertises the store. The distributer is fair and displays all the content on the shelves in an equal manner.

One of the content providers doesnt *want* it to be equal. They dont like just being one of many on the shelf. They want a big display focusing on their content and want to put the competing content in a random pile on the bottom shelf so only the most determined can find it.

So this content provider decides he wants his own shelf in the store. Who does he enlist for help? The owner of the land, who just happens to be a bowling buddy. The land owner tells the store owner that if he doesnt let his buddy have his own space in the store he is going to kick him off the land (despite having a 15 year lease).

Does this sound right? Heck does it even sound legal?
If I were that store owner I would be enraged. How dare the landowner force my business to use a friend of his for his own personal profit even though it could hurt my business!
I would sue in an instant.
