Michael, you are absolutely right, and such a discovery process will find market estimates that are not 1/10 of those presented by the company as "facts". Even if the company published numbers about the market are supported by some internal documents (and from having personally looked at that field, IMHO they are outrageously overstated), the file will always contain some other internal numbers that are much more realistic and the fact that only the big numbers where publicized while the smaller market estimates were pushed under the carpet will be construed as fraud by some juries. I doubt Wexler will see the inside of a court on this. If he does, all the employees associated with shredding machines will be called in to describe what was shredded.
