That is what I think .. this condition seems like a strange scenario. This little tactic if not considered just and fair could get the SEC all over this one in a heartbeat.

I do not have any and not worth the 5% if this turms out to be illegal or stock manipulation. Too risky for me.

Stick to the old rule if they want you to call for certs. SELL!
