Perhaps in some sense to this point: a few years ago Roger Myers, BW's counsel, represented a California ISP called Electriciti in a lawsuit known as Aquino v. Electriciti.

Electriciti had been sued by a couple of nutball Satanists who wanted to hold the ISP liable for what they claimed to be libelous statements made by people accessing Usenet groups through Electriciti.

Myers successfully argued that Electriciti was only the means of transmission of the material in question, not its originator or "publisher", and therefore was not liable.
