When people stop suing brokers after they lose money under the theory that the brokers should have prevented them from acting on their own stupid ideas.

This is a serious problem, and Fidelity is right to be cautious. Maybe it's wrong for them to target short-selling, but, if we want more freedom, then we better be prepared to support legislation that precludes this kind of lawsuit.
