CDMA, as TERN has shown, is an effective means of optimizing scarce bandwidth resources in the upstream path of bidirectional coaxial systems (where HFC has not been deployed). This doesn't mean that it is precluded from being used on HFC as well, rather, it is seen as a means to allow smaller operators who can't afford the upgrades to forego the HFC process altogether, and stick with coax only.
I am not as well versed in CDMA over cable as I would like to be, and I have not followed the litigation to any extent. Someone who would know more than I do about these matters (actually, quite a few folks on the Last Mile thread) would be Dave Horne or Dr. Bernard Levy, or Denver Techie. I'd suggest popping this one on them either on the TERN or BRCM threads, or over in the last mile.
