North American Vaccine Announces U.S. Federal District Court Dismisses Lawsuit Filed By Former President
All Claims Against the Company and its Directors Dismissed
COLUMBIA, Md., June 23 /PRNewswire/ -- North American Vaccine announced today that in a 27 page written opinion, the U.S District Court, District of Maryland, has dismissed all claims filed by Sharon Mates, the company's former president, against the company, the two named directors and its affiliate, BioChem Pharma Inc.
Daniel Abdun-Nabi, Senior Vice President-Legal Affairs & General Counsel for North American Vaccine stated: "The decision issued by the U.S. District Court in its written opinion confirms the company's earlier statement that we believed the lawsuit to be without merit. While this case may be appealed by Dr. Mates, we see no basis for a federal Circuit Court to overturn the District Court's well reasoned decision that is thoroughly supported by legal precedent."
The lawsuit was filed by Dr. Mates in November 1998 and included claims against the company and two directors for, among other things, abusive discharge, defamation, interference with business relations, and breach of contract. In December 1998, the company responded by filing a motion to dismiss seeking a court order dismissing all claims on the basis that the allegations in the complaint are not recognizable under applicable law. |
