Indeed, and some commentators have said that it is in the pioneering efforts of the state supreme courts that the advancement of human and civil rights in the US rests. The Hawaii constitution and supreme court have declared aboriginal rights of worship on private land, access to beaches, an inherent right of privacy, and even the right of two people of the same sex to be married (later changed by legislative and popular override.)
