The whole point of a bill of rights is NOT to put rights issues to the vote. If we put prisoner rights to the vote, what would happen? If we put flag burning to a vote? The right to read pornography? The right to a government-paid lawyer to defend you? The right to abortion? Should basic rights change as one political position or another holds sway? If we vote for abortion rights under Jimmy Carter should we then be able to vote against them one Reagan gets elected? I forget who used the wonderful phrase "the tyranny of the majority." But it is too often true. Just look at mobs. There were some very good reasons why the Founding Fathers (no Founding Mothers need apply) set this country up as a Republic, NOT a democracy.
