And so you are saying I am correct about not being able to countersue for malicious prosecution, because you can't meet an element until the underlying case is terminated:

(2) a termination of the proceeding in favor of the defendant therein;

Thus you have to file the action after the first one is terminated. The elements are the same in most states.
