"Who defines when a person or group is being "threatened"?"

The courts, of course. When a reasonable person could apprehend that he was in danger of being subjected to violence he is being threatened or assaulted, depending on the wording of the statute in the state. No reasonable person (even if he owned a flag factory) could reasonably apprehend that he was being threatened by a burning flag. But when a mob of white-sheeted creeps burns a cross on my lawn I reasonably reach for the old 12 gauge and squeeze off a few well-directed rounds. If I wing one, no jury would convict. So the state passes laws against cross-burning and hate speech expected to lead to a breach of the peace and the courts sometimes think its an excellent idea. I would prefer to shoot the bastards myself. No one plants a religious symbol on my lawn with impunity.
