Good article. And I believe the FCC's Kennard recently indicated he'd rule in favor of cable interests.

One a different subject --- CDMA patents -- I have a question on Broadcom. Last week STII was acquired by NN in a transaction that includes all their patents both issued and pending. Prior to the announcement, STII settled their lawsuit with Broadcom --- and BRCM's reciprocal lawsuit against STII --- with BRCM getting non-exclusive right to certain patents and the option to license CDMA over coaxial cable technology.

Considering the right is non-exclusive, I would imagine anyone wanting to develop cable modem chips will license the same technology (now held by NN) and compete head-to-head with BRCM. Am I right to assume this will be positive for CMTO? In other words, the more chip competition there is, the lower the prices will likely be? If so, who are the likely developers? I tried doing a CDMA subject search to see who might already have similar patents and while I found lots of references, I couldn't tell what was what.

A glance at the competition's patents related to CDMA:

Robert Bosch:
164.195.100.11

Motorola (CDMA/ASICs)
164.195.100.11 adv.htm&r=0&f=S&l=50&d=PALL&OS=Motorola+AND+CDMA&RS=%28Motorola+AND+CDMA%29&TD=439&Srch1=%28Motorola+AND+CDMA%29&StartNum=&Refine=Refine+Search&Query=Motorola+AND+CDMA+AND+ASICs

Lucent (CDMA/ASICs)
164.195.100.11 adv.htm&r=0&f=S&l=50&d=PALL&OS=Motorola+AND+CDMA+AND+ASICs&RS=%28%28Motorola+AND+CDMA%29+AND+ASICs%29&TD=18&Srch1=%28%28Motorola+AND+CDMA%29+AND+ASICs%29&StartNum=&Refine=Refine+Search&Query=Lucent+AND+CDMA+AND+ASICS

Note the date on this one:
164.195.100.11

Alcatel and CDMA:
164.195.100.11 adv.htm&r=0&f=S&l=50&d=PALL&OS=Lucent+AND+CDMA+AND+cable+AND+modems&RS=%28%28%28Lucent+AND+CDMA%29+AND+cable%29+AND+modems%29&TD=2&Srch1=%28%28%28Lucent+AND+CDMA%29+AND+cable%29+AND+modems%29&StartNum=&Refine=Refine+Search&Query=Alcatel+AND+CDMA

If anyone knows how to read these documents, or knows how the competitive landscape will develop, I welcome your comments. Perhaps Mark could give a general answer, without reference to any particular company.

Thanks in advance.

Pat
