24601, it seems to me an attempt to quash freedom of expression by filing frivolous lawsuits is an abuse of the system. You can argue all day that filing these suits does not impair freedom of speech, but that is their express purpose. The California legislature agrees, and has passed anti-SLAPP statutes. You are correct in your examples, but they are irrelevant because no one is suing because they did not have a letter to the editor published. I don't see anything wrong with putting the plaintiff in a SLAPP suit on notice that the defendant is not going to roll over and play dead.
