That was a good response.

Ebay is a facilitating agent for bringing buyers and sellers together. When such firms are compensated by one party only, there is a real question as to who their "customer" really is. Recently I sold a home, and I became very agitated with my real estate broker when I began to feel she was taking the buyer's side over mine on several issues (naturally, as the seller I was paying the entire commission).

With regard to the warning on eBay about software piracy ... I think we have to realize that with auctions buyers are victims far more often than sellers. Indeed, it is hard to think of how a buyer could victimize a seller, other than by simply not completing the transaction. Sellers, on the other hand, can victimize buyers in all sorts of ways ... by misrepresenting the condition of merchandise, selling phony "antiques," keeping the money and not shipping, etc. Sending money to strangers is always going to be a crap-shoot. Before the outages issue came up, the main allegation against eBay was the selling of contraband items -- guns, drugs, pornography and the like. The nature of the beast is that eBay is always going to have more problems with sellers than with buyers.

I think we need to cut some slack for eBay in their good faith efforts to keep sellers honest and within the law. Even if that sometimes means warnings that seem unfair to honest sellers such as yourself.
