Does the First Amendment cover spelling? You better hope so.

In fact, I believe it does include lying up to the point where it becomes libel, slander or defamation (or a threat to public safety).

I can say that I am 100% positive the New Orleans Saints will win the Super Bowl this year. It is a lie, but it is not actionable.

I will leave it up to the lawyers to define the other categories. And SI gets to decide who violates its Terms of Use. Fortunately they seem to be cracking down on the worst offenders.
