it is highly unlikely that discovery would go out by a defendant ahead of actually be served. To do so might constitute a waiver of the due order of pleas, to the jurisdiction, to venue and special exceptions.

And that's why I advised against it.

but I don't think I would do that, as the notice may constitute "an appearance" by the defendant prior to service of the summons.

Especially risky as to the waiver of objection for personal jurisdiction.

What's even more likely is that defendants won't get served at all.

The text of the complaint has been deleted from SI. What was the basis for jdx? Diversity? It's pretty risky naming specific does in a complaint that may wreck diversity jdx.
