Mr. Burns, if this is you, why do you not want to comment "on the record" yet you've talking about it here. Don't you know that Silicon Investor is just as much "THE RECORD" as that magazine article is.

"I don't want to say anything. I've never been sued before," said Mike Morelock of Greenwood, Ark., who was named as a defendant in ZiaSun's lawsuit.

Morelock, a trader who posted Internet messages under the alias C.M. Burns, said he did not want to comment on the record about the case."

For your information, Silicon Investor is a record and even though it is hearsay, can be admitted for impeachment as "a prior inconsistent statement" as an exception to the hearsay rule.
